Term from the Portuguese penal code. Complete sentence reads: Tendo o arguido mais de um defensor constituído, as notificações são feitas àquele que for indicado em primeiro lugar no acto de constituição.
The text is part of a 'carta rogatória' adressed at the Dutch authorities to bring someone to justice.

I always prefer a verb to a noun in English. Vive-versa, I always prefer a noun to a verb in Portuguese.

when defence counsel was constituted

o "acto de constituição" é a "constituição de defensor". Se o arguido constituir mais do que um defensor, as notificações são enviadas apenas ao primeiro nome indicado na lista dos defensores constituídos. Por não conhecer o termo específico (se há) para o "acto de constituição", eu diria algo como "...to the first attorney listed at the time when defence counsel was constituted."

Anyone with a more elegant way of say that... welcome! Suggestions appreciated. So the Highest Confidence relates to the idea of the original...always looking for a better way to say it.
