A frase seria muito mais compreensível sem o tal do "sendo que", veja:
" ... as ações. As referidas Ações encontram-se completamente livres e desembaraçadas de todos ..."
Outra opção: "...as ações, que se encontram completamente livres e desembaraçadas ..."
Therefore, when you translate, change the punctuation to say: " ... the stocks. Such stocks are entirely free and unencumbered from any and all ..." ou " stocks that are entirely free and unencumbered ..."

: sendo que (ou desde que) estabelece condição no texto original, mesmo que mal colocada gramaticalmente, não pode ser excluída. Acredito que se deve manter o mesmo sentido em inglês.

O sentido fica mantidíssimo com as traduções que sugeri. Não se está estabelecendo condição, mas afirmando um fato. Não se escreve assim, em bom português. Nem em inglês. Frases curtas são preferíveis.
