Danach gehört ein Kind dann zum Haushalt eines Elternteils, wenn es dort wohnt, versorgt und betreut wird, so dass es sich in der Obhut dieses Elternteils befindet. Formale Gesichtspunkte, z.B. die Sorgerechtsregelung oder die Eintragung in ein Melderegister, können bei der Beurteilung, in welchen Haushalt das Kind aufgenommen ist, allenfalls unterstützend herangezogen werden. Ein Obhutverhältnis in dem geschilderten Sinne besteht allerdings dann nicht, wenn sich das Kind nur für einen von vornherein begrenzten, kurzfristigen Zeitraum bei einem Elternteil befindet, etwa zu Besuchszwecken oder in den Ferien.

Wenn ich den Absatz richtig verstehe, geht es hier um die Situation VOR der Scheidung, jedoch NACH der Trennung der Eltern, wenn das Kind bei einem Elternteil lebt. Guardianship ist hier m. E. nicht richtig, denn dies bezeichnet die Vormundschaft über eine Person. Hier scheinen aber beide Eltern für das Kind verantwortlich zu sein und das Kind hat keinen anderen Vormund als die Eltern.

: nicht wenn noch kein gerichtl. Beschluss besteht, wie es hier der Fall zu sein scheint. Sollte in BE übersetzt werden, wäre custodial übrigens veraltet (heißt heute residence order).
