An investigational drug is one that has not been approved for sale in the United States by the U.S. Food and Drug Administration (FDA).

Purpose of the Main Research Study:
The purpose of this study is to determine if xxx therapy is superior to docetaxel in subjects with c-Met overexpressing (c-Met+) epithelial growth factor receptor (EGFR) wildtype, non-squamous, Non-Small Cell Lung Cancer (NSCLC) that has progressed after standard of care therapies.
Detailed information and consent for the research study is contained in a separate document which will be discussed with you by the study doctor.
Purpose of the Pre-Screening
You are being asked whether you would like to voluntarily participate in the first step of a screening process for a research study because you have been diagnosed with and treated for Non-Small Cell Lung Cancer.
The purpose of this pre-screening is to see whether your tumor shows evidence of increased c-Met protein.
This is the first step in determining if you are suitable to participate in the research study.
Pre-Screening Information
If you agree to participate in this first screening step and by signing this pre-screening consent, you are agreeing to provide a sample of your tumor tissue, either fresh biopsy or an archived tissue (tissue that was previously collected and preserved) so that we may see whether your tumor tissue has c-Met protein overexpression or c-Met positive (+) status.
Your tumor tissue sample will be tested at a laboratory chosen by xxx or its designee that is different than your doctor's facility.
Your tumor must have c-Met protein overexpression (c-Met positive (+) status) in order for you to be able to participate in the main research study.
If you qualify for participation in the study based on c-Met positive status, additional tumor material may have to be obtained during the Screening period in order to participate in the study.
Your doctor will discuss the details with you.
Regardless of the pre-screening test results, xxx will keep a portion of your tumor material for on-going development of biomarker and diagnostic-related tests and research pertaining to xxx and Non-Small Cell Lung Cancer.
If you withdraw or are withdrawn from participating in the study, the biological samples that we have collected from you as part of the main study or optional research will continue to be stored and analyzed as described in this form unless you specifically take back your permission to use your biological samples.
If you want to take back your permission to use your biological samples, you must let the study doctor know in writing.
If you take back your permission to use your biological samples, no new research work will be started, and your biological samples will be destroyed unless a regulatory authority requires xxx to keep them.
If xxx and/or other researchers did any testing of your biological samples before you took back your permission, xxx will still use and disclose the test results and keep the data generated from your biological samples due to regulatory requirements that are designed to safeguard scientific integrity.

Účelom tejto predskríningovej časti je zistiť, či váš nádor vykazuje znaky zvýšenej hladiny proteínu c-Met.
Je to prvý krok v procese stanovenia vašej vhodnosti na účasť vo výskumnom skúšaní.
Informácie o predskríningovej časti
Súhlasom s účasťou v tomto prvom kroku skríningu a podpísaním tohto súhlasu s predskríningovou časťou vyjadrujete svoj súhlas s poskytnutím vzorky nádorového tkaniva, buď ako čerstvej biopsie, alebo archivovaného tkaniva (tkaniva, ktoré bolo odobraté v minulosti a zachovalo sa), aby sme mohli zistiť, či vaše nádorové tkanivo nadmerne exprimuje c-Met proteín alebo je c-Met pozitívne (+).
Vzorku vášho nádorového tkaniva bude testovať laboratórium, ktoré vyberie spoločnosť xxx alebo ňou poverené zariadenie, a nepôjde o pracovisko vášho lekára.
Aby ste sa mohli zúčastniť hlavného výskumného skúšania, váš nádor musí nadmerne exprimovať c-Met proteín (musí mať status c-Met pozitivity (+)).
Ak budete spôsobilý/-á na účasť v skúšaní na základe pozitívneho c-Met statusu, na to, aby ste sa mohli zúčastniť skúšania, možno bude počas skríningového obdobia potrebné odobrať ďalší nádorový materiál.
Podrobnosti vám oznámi váš lekár.
Bez ohľadu na výsledky predskríningových testov si spoločnosť xxx ponechá časť nádorového materiálu na prebiehajúci vývoj testov spojených s biologickými ukazovateľmi a diagnostikou a výskum súvisiaci s xxx a nemalobunkovým karcinómom pľúc.
Ak svoju účasť v skúšaní zrušíte alebo bude zrušená, biologické vzorky, ktoré sme vám odobrali v rámci hlavného skúšania alebo nepovinného výskumu, budú uskladnené a analyzované, ako je to opísané v tomto formulári, za predpokladu, že svoje povolenie na použitie vašich biologických vzoriek výslovne nestiahnete.
Ak chcete stiahnuť povolenie na používanie vašich biologických vzoriek, musíte o tom písomne informovať skúšajúceho lekára.
Ak stiahnete svoje povolenie na používanie vašich biologických vzoriek, nezačnú sa vykonávať žiadne nové výskumné práce a vaše biologické vzorky budú zničené, ak regulačný orgán nebude od spoločnosti xxx požadovať, aby ich uchovávala.
Ak spoločnosť xxx alebo ostatní výskumní pracovníci podrobili vaše biologické vzorky testovaniu, skôr ako ste svoje povolenie stiahli, spoločnosť xxx bude kvôli regulačným požiadavkám, ktoré majú za cieľ zaistiť celistvosť vedeckého výskumu, môcť výsledky testov naďalej používať a sprístupňovať a uchovávať údaje vytvorené na ich základe.

Vzhľadom na to, že xxx. a Meno a Priezvisko (ďalej spolu ako „strany“) budú počas vzájomnej spolupráce na základe uzatvorenej zmluvy prichádzať do styku s dôvernými informáciami týkajúcej sa druhej strany, strany sa s cieľom upraviť súvisiace práva a povinnosti vo vzťahu k dôverným informáciám dohodli na uzavretí dohody v nasledujúcom znení:
Článok I
Predmet dohody
Strany sa zaväzujú udržiavať v tajnosti všetky dôverné skutočnosti, informácie, obchodné tajomstvo, dokumentáciu, zmluvy a ich obsah, know-how a iné údaje (napr. údaje o hospodárskych výsledkoch, obchodných partneroch, účastiach v projektoch, pripravovaných projektoch, technických riešeniach, marketingových údajoch atď.), vrátane osobných údajov predovšetkým klientov a ostatných zamestnancov a akýchkoľvek iných skutočností, ktoré sa týkajú a/alebo súvisia s predmetom činnosti jednej zo strán, ktoré jedna zo strán poskytne (ďalej len „poskytujúca strana“) druhej strane (ďalej len „prijímajúca strana“) alebo prijímajúca strana získa zo špecifických dokumentov, informačných systémov alebo iných zdrojov sprístupnených poskytujúcou stranou alebo ktoré budú označené ako „DÔVERNÉ”, „TAJNÉ”, alebo iným obdobným spôsobom vyjadrujúcim ich dôvernú povahu (ďalej len „dôverné informácie”).
Strany prehlasujú, že sú si vedomé svojich práv a povinností vyplývajúcich z aktuálne účinnej legislatívy týkajúcej sa ochrany osobných údajov, ako aj zodpovednosti za ich porušenie, a zároveň sa zaväzujú zachovať ochranu takýchto osobných údajov podľa týchto predpisov.
Povinnosť strán zachovávať mlčanlivosť podľa tejto dohody nie je časovo obmedzená.
Prijímajúca strana sa zaväzuje:
neposkytnúť ani nesprístupniť získané dôverné informácie tretej osobe bez predchádzajúceho písomného súhlasu poskytujúcej strany;
zabrániť neoprávnenej manipulácii s dôvernými informáciami, t. j. vyzradeniu, zneužitiu, poškodeniu, zničeniu, strate, odcudzeniu alebo použitiu dôverných informácii v rozpore s touto zmluvou a/alebo bez predchádzajúceho písomného súhlasu poskytujúcej strany;
vytvoriť a zachovávať vo vzťahu k dôverným informáciám poskytnutým poskytujúcou stranou v zmysle tejto zmluvy rovnaké opatrenia na ochranu dôverných informácii ako vo vzťahu k vlastným dôverným informáciám, t. j. vytvoriť a zachovávať podmienky na personálnu bezpečnosť, administratívnu bezpečnosť, šifrovanú ochranu informácií, fyzickú bezpečnosť, objektovú bezpečnosť, bezpečnosť technických prostriedkov a priemyselnú bezpečnosť, ktoré musia spĺňať základné kritériá ustanovené všeobecne záväznými právnymi predpismi a ktorých úlohou je chrániť dôverné informácie pred neoprávnenou manipuláciou;
využívať, reprodukovať alebo rozosielať dôverné informácie výlučne na účely, na aké boli poskytnuté;
obmedziť sprístupnenie dôverných informácií iba na tých svojich zamestnancov/spolupracovníkov, ktorí sa potrebujú oboznámiť s dôvernými informáciami na základe definovaného účelu ich poskytnutia a oboznámiť týchto zamestnancov s povinnosťou dôverné informácie chrániť v rozsahu stanovenom touto zmluvou;
nezverejní akýkoľvek údaj týkajúci sa dôverných informácii, nosičov dôverných informácii alebo ich obsahu.
Záväzok udržiavať dôverné informácie v tajnosti sa neuplatňuje na:
informácie, ktoré sú známe a dostupné verejnosti v čase podpisu tejto dohody;
informácie, ktoré po podpise tejto dohody sa stanú známe a dostupné verejnosti inak ako prostredníctvom konania prijímajúcej strany porušujúcim záväzok zachovávania mlčanlivosti podľa tejto dohody;
v prípade, keď prijímajúca strana je povinná na základe zákona poskytnúť dôverné informácie; povinnosťou prijímajúcej strany bude písomne oznámiť poskytujúcej strane skutočnosť, že takáto povinnosť poskytnúť dôverné informácie na základe zákona vznikla, spôsob a rozsah vykonania tejto povinnosti.
Sprístupnením dôvernej informácie prijímajúca strana nezískava a ani pre ňu z takéhoto sprístupnenia nevyplýva poskytnutie licencie, ani akéhokoľvek iného práva k duševnému vlastníctvu chránenému patentom, autorským právom, ochrannou známkou, alebo akéhokoľvek iného práva k priemyselnému vlastníctvu alebo k inému duševnému vlastníctvu.
Prijímajúca strana súhlasí a zaväzuje sa, že bude všetky dôverné informácie oddeľovať od ostatných informácií v záujme predchádzania ich zmiešaniu sa.
Prijímajúca strana bude oboznamovať poskytujúcu stranu ihneď po zistení o neoprávnenom použití, poskytnutí alebo zverejnení dôverných informácií alebo o inom porušení povinnosti podľa tejto dohody prijímajúcou stranou alebo inou osobou.
Prijímajúca strana bude akýmkoľvek primeraným spôsobom spolupracovať s poskytujúcou stranou pri znovu obnovení ochrany dôverných informácií a zabránení ich ďalšiemu neoprávnenému použitiu.
Ochrana dôverných informácii podľa tohto článku sa vzťahuje i na nosiče dôverných informácii (t. j. akýkoľvek originál, kópia, reprodukcia alebo zhrnutie dôverných informácií, ktoré boli pripravené priamo alebo nepriamo vo forme dokumentov, listín, poznámok a iných písomnosti, taktiež, no nie výlučne, elektronických verzií alebo kópií, ako sú napr. e-mail, počítačové súbory, CD/DVD, či už v zdrojovom alebo strojovom kóde alebo normálne čitateľné), ktoré boli pripravené poskytujúcou stranou alebo poskytnuté prijímajúcej strane poskytujúcou stranou (ďalej ako „nosiče dôverných informácii“).
Prijímajúca strana sa zaväzuje odovzdať poskytujúcej strane alebo zničiť na jeho požiadanie všetky nosiče dôverných informácii.
Článok II
Ostatné povinnosti prijímajúcej strany
Prijímajúca strana sa zaväzuje, že pri spracovávaní, odosielaní a prijímaní dôverných informácií v elektronickej alebo akejkoľvek inej podobe bude postupovať so zvýšenou opatrnosťou a ochranou zamedzujúcou ich zneužitie alebo sprístupnenie tretím osobám.
Prijímajúca strana sa zaväzuje bezodkladne informovať poskytujúcu stranu o skutočnosti alebo udalosti, ktorá môže mať za následok akýkoľvek neoprávnený prístup do systému alebo k dôverným informáciám poskytujúcej strany.

Due to the fact that in the course of mutual cooperation based on a concluded contract, xxx and name and surname (hereinafter collectively referred to as “the Parties”) will come into contact with confidential information concerning the other Party, the Parties agree to conclude the agreement as follows:
Article I
Subject of the Agreement
The Parties undertake to keep confidential all confidential matters, information, trade secret, documentation, contracts and their content, know-how and other data (e.g. data on economic results, business partners, participation in projects, projects in preparation, technical solutions, marketing data, etc.), including personal data, especially of clients and other employees and any other facts relating to and/or associated with the business of one of the Parties that one Party provides (hereinafter only referred to as “the Provider”) to the other Party (hereinafter only referred to as “the Receiver”) or the Receiver obtains from specific documents, information systems or other resources made available by the Provider or marked as “CONFIDENTIAL”, “SECRET” or in any other similar manner expressing their confidentiality (hereinafter only referred to as “the Confidential Information”).
The Parties declare that they are aware of their rights and obligations under the applicable legislation on the protection of personal data, as well as of their responsibility for their violation, and at the same time undertake to ensure protection of such personal data under these regulations.
The obligation of the parties to maintain confidentiality under this Agreement is not limited in time.
The Receiver undertakes:
not to provide or disclose the obtained Confidential Information to a third party without the prior written consent of the Provider;
to prevent any unauthorized handling of the confidential information, i.e. its disclosure, misuse, damage, destruction, loss, theft or use of the Confidential Information in violation of this Agreement and/or without the prior written consent of the Provider;
to establish and maintain with relation to the Confidential Information provided by the Provider under this contract the same measures to protect the Confidential Information as the Receiver uses in relation to its own confidential information, i.e. to create and maintain conditions for personnel security, administrative security, encrypted information protection, physical security, object security , the safety of technical means and industrial security, which must all meet basic criteria laid down by generally binding legal regulations and which serve to protect the Confidential Information against unauthorized handling;
to use, reproduce or distribute the Confidential Information solely for purposes for which it was provided;
to limit the disclosure of the Confidential Information only to those employees/associates who need to know such Confidential Information for the purpose for which such Confidential Information had been provided and to make those employees aware of their obligation to protect the Confidential Information to the extent provided for in this Agreement;
not to disclose any information regarding the Confidential Information, carriers of the Confidential Information or their content.
The obligation of confidentiality shall not apply to:
information which is known and available to the public at the time of signature of this Agreement;
information which, after the signature of this Agreement, becomes known and available to the public not by means of actions of the Receiver in breach of the obligation of confidentiality under this Agreement;
in the event that the Receiver is required by law to provide the Confidential Information; the Receiver will be obliged to notify the Provider in writing of the fact that an obligation to provide the Confidential Information has been established by law, and of the manner and extent of performance of this obligation.
By disclosure of the Confidential Information, the Receiver does not obtain any license, nor does it become obliged to grant a license or any other intellectual property right protected by a patent, copyright, trademark, or any other industrial or other intellectual property right.
The Receiver agrees and undertakes to separate all Confidential Information from other information in order to prevent any mixing.
The Receiver shall notify the Provider immediately upon discovery of any unauthorized use, provision or disclosure of the Confidential Information or any other breach of duty under this Agreement by the Receiver or any other person.
The Receiver shall appropriately cooperate with the Provider in restoring the protection of the Confidential Information and in order to prevent its further unauthorized use.
Protection of the Confidential Information under this Article shall also apply to carriers of the Confidential Information (i.e. any original, copy, reproduction or summary of the Confidential Information prepared directly or indirectly in the form of documents, papers, notes and other written materials, including, but not limited to, electronic versions or copies, such as e-mail, computer files, CDs/DVDs, whether in source or machine code or normally readable) prepared by the Provider or provided by the Provider to the Receiver (hereinafter referred to as “the Confidential Information Carriers”).
The Receiver undertakes to hand over to the Provider or to destroy at the request of the Provider all Confidential Information Carriers.
Article II
Other Obligations of the Receiver
The Receiver undertakes to exercise increased caution and ensure protection when processing, sending and receiving the Confidential Information in electronic or any other form, preventing its misuse or disclosure to third parties.
The Receiver undertakes to promptly inform the Provider of any fact or event that may result in any unauthorized access to the System or to the Confidential Information of the Provider.
