kortlopend huurcontract Explanation: Het lijkt erop dat de term "bail précaire"niet altijd juist wordt gebruikt en dat de term nogal eens verward wordt met "bail dérogatoire". Op de site van de Chambre de Commerce et d'Industrie de Paris (http://www.inforeg.ccip.fr/PDF/?doc_n_id=6114&arb_n_id=66) staat de volgende uitleg: Le bail de courte durée, également nommé bail dérogatoire, est régi par l'article L.145-5 du Code de commerce. Il permet aux parties de déroger au statut des baux commerciaux dès lors que que la durée totale du bail ou des baux successifs n'est pas supérieure à deux ans. Il est souvent appelé à tort"bail précaire" ou "bail de 23 mois". Il est à noter que le bail de courte durée n'offre pas au locataire la protection du bail commercial et la pérennité nécessaire pour fidéliser une clientèle, rentabiliser et faire fructifier une activité.
