Commitment of defendant
1. In general. When a sentence of imprisonment is pronounced, or when the sentence consists of a fine and the court has directed that the defendant be imprisoned until it is satisfied, the defendant must forthwith be committed to the custody of the appropriate public servant and detained until the sentence is complied with.
* 2. Indeterminate and determinate sentences. In the case of an indeterminate or determinate sentence of imprisonment, commitment must be to the custody of the state department of correctional services as provided in subdivision one of section 80.20 of the penal law. The order of commitment must direct that the defendant be delivered to an institution designated by the commissioner of correctional services in accordance with the provisions of the correction law.

* 2. Indeterminate and reformatory sentences. In the case of an indeterminate or reformatory sentence of imprisonment, commitment must be to the custody of the state department of correctional services as provided in subdivision one of section 70.20 and section 85.05 of the penal law. The order of commitment must direct that the defendant be delivered to an institution designated by the commissioner of correctional services in accordance with the provisions of the correction law.

3. Definite and intermittent sentences. In the case of a definite or intermittent sentence of imprisonment, commitment must be as follows:
(a) In counties contained within New York City or in any county that has a county department of correction, commitment must be to the custody of the department of correction of such city or county;
(b) In any other case, commitment must be to the county jail, workhouse or penitentiary, or to a penitentiary outside the county and the order of commitment must specify the institution to which the defendant is to be delivered.
* 4. Certain resentences. When a sentence of imprisonment that has been imposed on a defendant is vacated and a new sentence is imposed on such defendant for the same offense, or for an offense based upon the same act, if the term of the new definite or determinate sentence or the maximum term of the new indeterminate sentence so imposed is less than or equal to that of the vacated sentence:
(a) where the time served by the defendant on the vacated sentence is equal to or greater than the term or maximum term of the new sentence, the new sentence shall be deemed to be served in its entirety and the defendant shall not be committed to a correctional facility pursuant to said sentence; and
(b) where the defendant was under the supervision of a local conditional release commission or the division of parole at the time the sentence was vacated, then the commitment shall direct that said conditional release or parole be recommenced, and the defendant shall not be committed to a correctional facility pursuant to said sentence, except as a result of revocation of parole or of conditional release; and
(c) where the defendant was not under the supervision of the division of parole at the time the indeterminate or determinate sentence was vacated, but would immediately be eligible for conditional release from the new indeterminate or determinate sentence, the court shall ascertain from the department of correctional services whether the defendant has earned a sufficient amount of good time under the vacated sentence so as to require the conditional release of the defendant under the new sentence; in the event the defendant has earned a sufficient amount of good time, the court shall stay execution of sentence until the defendant surrenders at a correctional facility pursuant to the direction of the department of correctional services, which shall occur no later than sixty days after imposition of sentence; upon said stay of execution, the court clerk shall immediately mail to the commissioner of correctional services a certified copy of the commitment reflecting said stay of execution and the name, mailing address and telephone number of the defendant's legal representative; in the event the defendant fails to surrender as directed by the department of correctional services, the department shall notify the court which shall thereafter remand the defendant to custody pursuant to section of this article; and
(d) upon the resentence of a defendant as described in this subdivision, the court clerk shall immediately mail a certified copy of the commitment to the commissioner of correctional services if the vacated sentence or the new sentence is an indeterminate or determinate sentence and no mailing is required by paragraph (c) of this subdivision; additionally, the court clerk shall immediately mail a certified copy of the new commitment to the head of the appropriate local correctional facility if the vacated sentence or the new sentence is a definite sentence.

5. Commitment for failure to pay fine. Where the sentence consists of a fine and the court has directed that the defendant be imprisoned until it is satisfied, commitment must be as follows:
(a) If the sentence also includes a term of imprisonment, commitment must be to the same institution as is designated for service of the term of imprisonment, and the period of commitment commences (i) when the term of imprisonment is satisfied, or (ii) with the approval of the state board of parole, when the defendant becomes eligible for parole, or
(iii) when the defendant becomes eligible for conditional release, whichever occurs first; provided, however, that the court may direct that the period of imprisonment for the fine run concurrently with the term of imprisonment; and
(b) In any other case, commitment must be to the agency or institution that would be designated in the case of a definite sentence.

1 Disposiciones generales: cuando se dicta una sentencia de encarcelamiento o cuando la sentencia consiste en una sanción económica y el Tribunal o Juez ordena que el acusado sea encarcelado hasta que la satisfaga, éste deberá ser puesto inmediatamente bajo custodia judicial de las autoridades y a disposición judicial hasta que cumpla la sentencia.
*2. Sentencias de duración determinada o indeterminada. En caso de sentencia de encarcelamiento determinada o indeterminada, el auto de procesamiento será tramitado por el Departamento de Servicios Penitenciarios del Estado de Nueva York (The State Department of Correctional Services) como contempla el subapartado primero del artículo 80.20 del código penal. el auto de procesamiento establecerá que el acusado sea enviado a una institución designada por el responsable de los Servicios Penitenciarios conforme a lo dispuesto en la Ley Correccional de Nueva York.

*2. Sentencias indeterminadas y de reformatorio. En caso de sentencia indeterminada o de sentencia de ingreso en reformatorio, el auto de procesamiento será tramitado por el Departamento de Servicios Penitenciarios del Estado de Nueva York como contemplan el subapartado primero de la sección 70.20 [sic] y la sección 85.05 del código penal.el auto de encarcelamiento establecerá que al acusado sea enviado a la institución designada por el responsable de los Servicios Penitenciarios conforme a lo dispuesto en la Ley Correccional de Nueva York.

3.Sentencias definidas e intermitentes. En caso de sentencia definida o intermitente de encarcelamiento, el auto de procesamiento ha de cumplir los siguientes requisitos:
(a) En aquellos condados pertenecientes a la ciudad de Nueva York o en cualquier otro condado que cuente con un departamento penitenciario, el auto de procesamiento será tramitado por el Departamento de Corrección de dicha ciudad o condado;
(b) En cualquier otro caso, el auto de procesamiento será tramitado por la prisión para delitos menores, el taller penitenciario o una prisión para delitos mayores fuera del condado y la orden del auto de procesamiento especificará la institución a la que será enviado el acusado.
*4. Sentencias reformuladas. En caso de que una sentencia de encarcelamiento impuesta a un acusado sea revocada y una nueva sentencia sea impuesta a dicho acusado por el mismo delito o por un delito derivado del mismo acto, si la duración de la nueva sentencia definida o determinada o la duración máxima de la nueva sentencia indeterminada impuesta es menor o igual a la de la sentencia revocada:
(a) si el tiempo que el acusado ha cumplido de la sentencia revocada es mayor o igual que la duración o la duración máxima de la nueva sentencia, la nueva sentencia será considerada como cumplida en su totalidad y el acusado no será derivado a ninguna institución penitenciaria en virtud de lo dictado en la sentencia;
(b) si el acusado estuviera bajo supervisión de una Comisión Local de Libertad Condicional o del Departamento de Libertad Vigilada cuando la sentencia fuese revocada, al auto de procesamiento dictará la reanudación de dicha libertad condicional con suspensión de pena o libertad condicional sin suspensión de pena y el acusado no será derivado a ninguna institución penitenciaria en virtud de lo dictado en la sentencia salvo derogación de la libertad condicional;
(c) Si el acusado no estuviera bajo supervisión del departamento de libertad vigilada cuando la sentencia fuese revocada, pero tuviera derecho a libertad condicional de acuerdo con la nueva sentencia determinada o indeterminada, el Tribunal o Juez determinará a partir del Departamento de Servicios Penitenciarios si el acusado ha observado buena conducta durante el tiempo suficiente de la sentencia revocada para exigir libertad condicional bajo la nueva sentencia. En el caso de que el acusado hubiese observado buena conducta durante el tiempo suficiente, el Tribunal o Juez suspenderá la ejecución de la sentencia hasta que el acusado se persone en las instalaciones del servicio penitenciario conforme a la instrucción del Departamento de Servicios, en un plazo no mayor de 60 días tras la imposición de la misma. En caso de suspensión de la sentencia, el oficial del juzgado deberá remitir inmediatamente al responsable de los Servicios Penitenciarios una copia certificada del auto de procesamiento en la que se recoja dicha suspensión y el nombre, dirección postal y número de teléfono del representante legal del acusado. En caso de que el acusado no se persone tal como dicte el Departamento de Servicios Correccionales, éste lo notificará al Tribunal o Juez, que pondrá al acusado bajo custodia judicial conforme a la sección de este artículo;
(d) En caso de una sentencia reformulada tal y como se describe en este subapartado, el oficial del Tribunal deberá remitir inmediatamente una copia certificada del auto de procesamiento al comisionista de los Servicios Correccionales, si la sentencia revocada o la nueva sentencia es una sentencia determinada o indeterminada y no se requiere notificación tal y como dicta el párrafo (c) de este subapartado. Además, el secretario del tribunal deberá remitir inmediatamente una copia certificada del nuevo auto de procesamiento al responsable de la institución penitenciaria pertinente si la sentencia revocada o la nueva sentencia es una sentencia definida.

5. Auto de procesamiento por impago de una sanción económica. Si el Tribunal o Juez dicta el encarcelamiento del acusado hasta el pago de la sanción económica en la que consiste la sentencia, el auto de procesamiento ha de cumplir los siguientes requisitos:
a) Si la sentencia también incluye un pena de encarcelamiento, el auto de procesamiento debe pasar a la institución designada para dicha pena de encarcelamiento, y el período del auto de procesamiento incoa: 1. Cuando se cumpla el período de encarcelamiento o 2. Previa aprobación por parte del Comité de Libertad Condicional o Vigilada, cuando el acusado tenga derecho a libertad vigilada,
3. Cuando el acusado tenga derecho a libertad condicional, sin importar cuál de las dos tenga lugar primero; teniendo en cuenta, sin embargo, siempre que el Tribunal o Juez dicte que la pena de encarcelamiento para la sanción económica vaya anejo a la pena de encarcelamiento;
(b) En cualquier otro caso, el auto de procesamiento debe pasar al organismo o institución designado en caso de sentencia definida.
