Es por estas razones que la Suprema Corte de Justicia, al conocer sobre el recuso de casación, estatuyó en el sentido de casar la decisión por vía de supresión y sin envío, puesto que el recurso que era procedente en contra de la indicada decisión emanada por el tribunal de primera instancia era el denominado recurso de Impugnación o Le Contredit.
