This sentence is making my brain hurt. Evidently the intention is to be incomprehensible, and they have succeeded.
The preceding sentence is "Hágase saber a las partes que de común acuerdo podrán someter el litigio a mediación," and my question sentence is followed by another unrelated section. However, there is a double line break between this preceding sentence and the one below, so they may or may not be related.
My goal, out of spite and pure hatred for the author, is to make this into perfectly comprehensible English, but I would settle for anything that allows me to move on with my life.

Duly issue the letter rogatory
I don't see why "duly" wouldn't work here. And I think that by using "issue" you don't have to make any mention of "delivering" or "sending" it, as the Spanish does.

: I would say 'the appropriate rogatory letter to be issued' but this will be ok.

Thanks, Bill. I specifically chose "duly" to cover the "timely" aspect of "oportuno", and I don't think "appropriate" quite covers that.
