Spanish term

TESTAMENTO UNIPERSONAL ABIERTO

Spanish to English Law/Patents Law (general) TESTAMENTO
Tengo dudas con el término "unipersonal" en este contexto.

individual

I think most wills are 'unipersonal' anyway :)

So: an "open individual will" or "individual open will"

neutral AllegroTrans : "open personal will" is not in the ref. nor does it produce any ghits - have you any evidence that it is a correct legal term?

"Open will" is the common -and quite natural - translation of "testamento abierto"... Then "unipersonal" means that it relates to one person only. Litteral translation works here, imo.

nuncupative, unilateral (non-joint and non-mutual) Will

vs. a testamento mancomunado = a joint will in a single document signed by two persons, like husband & wife vs. a mutual will where 2 separate Wills are signed by two persons, like husband and wife, in each other's favour and which arguably are irrevocable during their lifetime. The Aussi case of Birmingham vs. Renfrew postulates that a joint or mutual will creates a floating trust which 'crystallises' on one party's death.

A Will is also a formof unliateral Deed Poll used more often in the UK for changes of name and partitioning of land.

Nuncupative - in ES an oral will attested by 7 witnesses and taken down by a Notary.

Example sentence:

Definition of deed poll: Unilateral deed. Deed that is executed by only one party (the sole party to it), or by two or more parties having identical interests. www.businessdictionary.com/definition/deed-poll.html

Gracias! We know a winner when we see one.
neutral John Rynne : as I understand it, "nuncupative" is purely verbal, whereas in a Spanish "testamento abierto ante Notario", the testator signs the will

unilateral open will / open will

An open will is one that the testator executes before witnesses and a notary. Normally wills are executed by one person so in most cases the title or name of the document would not say unilateral. However, some jurisdictions allow mutual or joint wills (testamentos mancomunados) and the name would so specify it. Source: Black´s Law Dictionary, 7th ed.
