IOW
(en faisant l’objet) and (en considération de leur origine) are TWO separate part of the sentence - if you try to make them ONE unit of meaning, then of course it won't work!

There is no actual mistake but the way the sentence is drafted is awkward; it would have been easier to understand if en had followed les biens immediately.

Simplified sentence: Pour exercer ce droit de retour, le donateur reprendra les biens [du lot] faisant l'objet de ce droit compte tenu/en fonction de leur origine. The right applies to les biens (cf. your second quote).
